As of 2026, 40 states plus the District of Columbia have enacted licensure laws for behavior analysts. The remaining 10 states (California, Colorado, Delaware, Florida, Idaho, Maine, New Hampshire, New Mexico, South Carolina, and West Virginia) do not require state licensure, though practitioners must still hold BACB certification.
Yes. In states without licensure laws, BCBA certification from the BACB is the primary credential needed to practice. All 50 states and DC recognize BCBA certification for insurance reimbursement, even without a separate state license.
BACB certification (BCBA, BCaBA, RBT) is a national credential administered by the Behavior Analyst Certification Board. State licensure is a separate legal requirement enacted by individual states. In licensed states, you typically need both BACB certification and a state license to practice. In unlicensed states, BACB certification alone is sufficient.
The BACB requires BCBAs to complete 32 continuing education units (CEUs) every 2-year certification cycle. At least 4 of those CEUs must be in ethics. Individual states with licensure may have additional CE requirements beyond the BACB minimums.
Most states allow telehealth ABA therapy delivery, though some have restrictions such as requiring an initial in-person assessment, specific consent documentation, or limitations on which services can be delivered remotely. Telehealth ABA expanded significantly after 2020 and is particularly important in rural states.
The BACB recommends a supervision ratio of approximately 1 BCBA per 6–8 RBTs. Some states with licensure laws set their own supervision ratios and requirements, which may be stricter than the BACB baseline. Supervision must be ongoing and documented regardless of the state.
There is no universal license reciprocity between states. If a BCBA moves to a new state with licensure requirements, they must apply for a license in that state. However, holding active BACB certification typically satisfies the core credentialing requirement, and many states have streamlined processes for BCBAs already certified by the BACB.
Nevada and Oklahoma were among the first states to enact behavior analyst licensure in 2009. Since then, 38 additional states and the District of Columbia have followed. The most recent states include Arkansas (2025), DC and Minnesota (2024), and Nebraska (2023).
